Payment and Shipping fees

Any order implies prior consultation and acceptance of these General Terms and Conditions of Sale, which are accessible at any time via a direct and permanent link on our website. These general terms and conditions of sale (GTC) govern the contractual relations between EmmanuelleGuyon and its customer, both parties accepting them without reservation. These GTCs take precedence over any other general or specific conditions not expressly agreed upon by EmmanuelleGuyon.

As a result, the consumer acknowledges being fully informed that his agreement regarding the content of these general terms and conditions does not require the handwritten signature of this document, to the extent that the customer wishes to order the products presented in the context of the Website Catalog. The consumer has the option to save or edit these general terms and conditions, it being specified that both the saving and the editing of this document are his sole responsibility. It is also understood that the acceptance of these general terms and conditions is a necessary step in the completion of the order, and that any order placed implies their acceptance without reservation.

We reserve the right to suspend any order management and delivery in the event of a refusal of payment authorization from officially accredited organizations or in the event of non-payment. We also reserve the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is being administered. This suspension or refusal shall not engage our liability and shall not give rise to any indemnification or compensation.

Payment method

We exclusively accept PayPal as our payment method. It is the most convenient and secure option for international orders. If you do not have a PayPal account, there’s no need to worry. How to buy

Using PayPal, select the item(s) of your choice on our website by clicking the "add to cart" button. You can access the summary of your cart at any time until the order is definitively validated in order to correct any errors in the data entry. The order is only recorded after payment confirmation.

REMINDER: Order confirmation implies acceptance of these sales conditions, acknowledgment of having perfect knowledge of them, and waiver of any other purchasing conditions or terms.
All the data provided and the recorded confirmation will serve as proof of the transaction. The confirmation will be considered as a signature and acceptance of the operations carried out.

Shipping

Shipments are made through the Mexican Postal Service, Los Correos de Mexico, from Mexico, where we currently reside.

Shipping costs are free. Your package is sent in registered mode with a tracking number that allows you to follow the progress of your order from Mexico to its destination. You can monitor its journey at each stage, from being picked up by the postal service to being delivered to your home.

We also offer an Express delivery service by private carrier, which significantly reduces delivery times. You will find this option in your shopping cart. Opting for this service ensures fast and secure delivery, ideal for urgent orders or last-minute gifts.

As with all international shipments, your order may be subject to customs fees. Each country sets the amounts, so it is the customer’s responsibility to inquire with the relevant authorities about any amount to be paid on their order. You are solely responsible for any additional costs applied to your order. We recommend checking the customs rules of your country before placing an order to avoid any unpleasant surprises upon receipt of your package.

Definition of the type of jewelry

In the terms of sale, we consider 2 categories of jewelry present in our online store.

  • Category A: it is formed by the jewelry for sale on our site and does not require any customization. This includes all jewelry for sale (except rings where you must specify your size), as well as rings with a single size mentioned in the description of the jewelry and presented on our pages belong to this first category.
    We also include in this group the personalized jewelry that you may have ordered from us based on your wishes and drawings, but which do not contain any personal data that would prevent us from reselling it in our store (name, date, personal quote... this list is not exhaustive. Please contact us for more information and to find out if your order falls within this framework).
  • Category B: these are personalized jewelry created from your specific wishes, with a drawing that you have proposed or a very personal element, such as a date of birth, a name... These jewelry items include Article L121-20-2 of the Consumer Code, which does not require a refund in the event of "Supply of goods made to the consumer’s specifications or clearly personalized...".
    This category also includes all rings or bands that we offer with a choice of size. We are not a company that can produce its rings in series and offer a wide range of sizes, and thus offer standard exchanges as easily. Each ring is a unique piece made by hand and each time involves several hours of work, as well as an investment in precious and non-precious materials and wear and tear on our equipment. The making of a ring to your size being personal, the jewelry is difficult to resell in case of return since it would be necessary to find a person with the same size. This is impossible for us and for our stock management.

Delivery time

Delivery times are generally 2 to 3 weeks, but can extend up to 6 weeks or more during holiday or festive periods. It is important to note that these delays are entirely normal and correspond to increased demand during these periods.

If the piece of jewelry is already made, it will be shipped within 2 to 3 days after receiving your payment. However, for custom orders such as a custom ring, please allow for a manufacturing time of 5 business days. It should be noted that this time frame may be extended depending on the complexity of the customization, including the reflection, testing, and design phase of the custom piece to meet your specific requirements.

We decline any responsibility for delays due to postal service strikes, holidays, bridges, and festive dates. Additionally, we are not responsible for any delays caused by the customs clearance process, which may vary from country to country.

Any delay or failure to perform the services provided under these terms and conditions shall not be considered a fault attributable to our company, provided that it can be justified that such delay or failure to perform results either from an action of the customer, or from an unforeseeable and insurmountable event caused by a third party to the contract, or from a case of force majeure as defined by the applicable regulations, in accordance with Article L. 121-20-3 of the Consumer Code.
According to this law, we cannot be held responsible for delays or losses of orders once we have correctly completed and shipped your order, as evidenced by the receipt from the post office confirming the shipment of our work to you. At this stage, the law does not require us to refund your jewelry in case of a problem. However, we always strive to ensure customer satisfaction and, as online buyers ourselves, we understand the importance of resolving these issues in the best possible way.

We can file a claim with the post office when the parcel has been sent for more than a month after the shipping date. A post office investigation can last up to 1 month from the start date of the investigation. However, it is important to note that in some exceptional circumstances, this period may be extended further. Rest assured that we will keep you informed of any developments throughout the process.

  • If during this period, the product is found, it will be immediately re-routed to your home (in the majority of cases). However, it is important to note that in some cases, re-shipping fees may apply, especially if the parcel was returned due to an incorrect or incomplete address provided by the customer. In this case, we will contact you to discuss the available options.
  • If, on the other hand, the product is not found at the end of the 31-day investigation period, it is then considered lost. It is only at this point that we can begin a dialogue with the customer to best resolve this issue. This may involve sending you a replacement product at our expense. We may also consider a partial refund of the jewelry, the amount of which will be judged on a case-by-case basis depending on the minimum costs we have incurred (raw materials, time, etc.). We want to emphasize that we do everything possible to avoid such situations, but in the event of loss, we are committed to finding a fair and satisfactory solution for all parties involved.

Order cancellation

An order cancellation for a jewelry belonging to category A will be considered if the jewelry has not yet been shipped. To cancel an order, please send us a cancellation email to contact@emmanuelleguyon.com as soon as possible.

Otherwise, if the jewelry has already been shipped; please refer to the refund paragraph.

For a category A jewelry, the cancellation will take into account the transaction fees incurred by your purchase. This specifically concerns the PayPal fees, amounting to 5%, which will therefore not be refunded to you. Please note this policy before finalizing your order.

As for category B jewelry, i.e. personalized jewelry, no order cancellation will be considered once we have completed the piece. This is because these jewelry are custom-made according to your specifications, making their resale difficult. We appreciate your understanding in this regard.

Withdrawal period

In accordance with Articles L121-16 to L121-23 of the Consumer Code in their version resulting from the Consumer Law of March 17, 2014, in force from June 13, 2014, you have a period of 7 days from the date of receipt of your parcel to withdraw, regardless of the reason. This withdrawal period is only valid for category A jewelry. Please note that personalized jewelry, belonging to category B, are not eligible for this withdrawal period, as they are made according to your individual specifications.

After notifying us, the jewelry must be returned to us in good condition. The transport costs and risks being borne by the customer, please send your package with a tracking number, and the jewelry carefully wrapped in the original box protecting it. Indeed, as long as we have not received the piece, there will be no refund. If your return package is lost because you did not send it with a tracking number, there will be no refund either.

Unless we are at fault, the return costs are at your expense. In the case of a defective product, we would cover all costs incurred by the customer.

Jewelry that has been worn, altered, and/or engraved cannot be returned or exchanged. Also, items in category B (special order, personalized, ring made to a specific size at your request) falling under Article L121-20-2 of the Consumer Code will not be returned or exchanged.

Refunds

When the jewelry reaches us, in impeccable condition, the refund will be made according to the category of the jewelry:

For a category A jewelry, the cancellation will take into account the transaction fees incurred by your purchase. This specifically concerns the PayPal fees, amounting to 5%, which will therefore not be refunded to you.

For a category B jewelry, i.e. personalized jewelry, no refund will be considered, except in the case of a manufacturing defect that may be attributable to us. These jewelry fall under Article L121-20-2 of the Consumer Code, which does not require a refund in the case of "supply of goods made to the consumer’s specifications or clearly personalized...". If the problem is related to the ring size, we use size standards and the best materials to ensure that we make what is requested of us. We take a photo on a ring mandrel of each ring as proof of our proper execution of the size specifications. We cannot therefore be held responsible for a measurement error on your part. There will therefore be no refund in this case, since we provided the ring as requested.

If you need to adjust the size, we invite you to consider the following options:

  • We are unable to make rings with stones due to technical constraints.
  • For a ring made entirely of silver or gold without stones, we can enlarge the size up to one additional French size. This service is available for a fee of 15 euros.
  • We can reduce the size of your ring if it is technically feasible. The price of this operation will be determined based on the complexity of the task.
  • The initial shipping costs as well as the return shipping costs will be at your expense.

The refund will be made either by PayPal or by check, according to your preference.

Note:

  • All stones used in our jewelry are natural, which means they may have inclusions, impurities, and/or imperfections. Please note that these characteristics are not grounds for a refund.
  • We take all necessary precautions to avoid any risk of allergy. All our jewelry is guaranteed nickel-free. However, as each person can react differently to products and materials, we cannot be held responsible for any allergies that may occur. Therefore, products will not be refunded in case of allergy.
  • All our silver jewelry is made from 925 silver, which means they contain 92.5% pure silver and 7.5% copper.
